What Is An Exclusive Buyer's Agent?

According to Consumer Reports, there are only 2,500 Exclusive Buyer Agents Nationwide, as opposed to the millions of Real Estate SALESpeople.  Our job is to locate, evaluate, negotiate for and then protect our Home Buyer Clients!

 

You make ALL of the home buying decisions and then we buy the home for you, as if we were buying it for our own family.  We NEVER SELL homes, and we NEVER have a conflict of interest! "We offer one stop, stress free home shopping with a consumer advocate, not a SALESperson."

 

As a buyer, if real estate was a tennis match, every time you step out on the court you are always alone and facing a doubles team of the seller and their agent. While a friendly agent may have introduced you to the game and given you a grand tour of the court, they are on the seller's side of the net to help them. Hiring us makes the game equal, or even to your advantage!

 

After riding around in a car for weeks looking at houses, bonding, confiding your finances and motivations, you may assume that the agent is negotiating for your best interests. Wrong! Traditional agents always represent the seller.

 

They are obligated by State Law to share all of their information about you with the seller, so that they can negotiate the best possible deal for their seller client. Unless you specifically contract with an exclusive buyer's agent to represent your best interests, the agent, even if it's your neighbor and best friend, legally must remain loyal to their seller client.

 

A negotiator can only take one side! We eliminate any uncertainty of getting the best deal possible. We are your full time advocate, researcher, advisor, confidant, negotiator and community expert. There is never a conflict of interest and you are always on equal footing with the sellers.

Q. How much does this service cost me?

A. There are no additional costs to the buyer! Although technically you are hiring the buyer agent, the compensation can come from the transaction. When the home is listed for sale, the listing agency offers to split their commission with the buyer agent, via the Statewide MLS. Example: 5% commission = 2.5% to the seller agent and 2.5% to the buyer agent. As long as commissions can be divided by 2 agents, one of those 2 real estate agents might as well be working for the buyers!

Q. Do you accept the cash bonuses that sellers are now offering to buyer agents?

A. NO! Accepting a bonus, would be a huge conflict of interest! Now that we have a buyer's market, many sellers are offering thousands of dollars (some as high as $25,000+) to the agent that brings the home buyer to the negotiating table. At Buyer1st.Com, all bonuses that may be involved in any transaction will be paid to the buyer at time of closing, not to the buyer agent. We will never promote one home over another for any reason, as that is strictly the home buyer's decision!

Q. Why would you negotiate a lower price, won't that reduce your fee?

A. The way that an MLS co-broke normally works is that on a 5% commission, 2.5% ( 50% ) would go to the seller's listing agency and 2.5% ( 50% ) to the buyer agency. The fee is then split once again 50/50 between the buyer agency and the buyer agent. For every $1,000 that we reduce the price for you, your buyer agent's fee is reduced by only $12.50.

Q. Do you provide a 1 year home warranty as part of my offer to purchase?

A. Yes! To protect our buyer clients, and to make sure that you always have "peace of mind", we provide and pay $435 to $655 for your 1 year home warranty which covers the minor and major components of your new home and protects home buyers against unexpected repairs. Even though the home warranty is a great bonus for our buyer clients, that is not the only reason why we provide it. The main reason why we provide the home warranty is because it is an extremely strong negotiating tool, that we use to obtain the best price and terms for your purchase. Including the home warranty as part of your offer makes your offer much stronger with the seller, due to the fact that the warranty eliminates possible lawsuits brought by buyers against the sellers, for breakdowns of the covered components after the sale is closed.

Q. Exclusive buyer agency sounds too good to be true, what's the catch?

A. There is no catch, no strings attached and absolutely no downside to hiring an exclusive buyer agent! It's extremely simple, we work for you and only for you! We give you an immediate advantage in the home buying process. You will be absolutely thrilled with the many benefits and clear advantages of having professional buyer representation.

Q. How do you find a home to match my needs?

A. We don't work under any restrictions or conflicts of interest that would direct or influence your home search. All the homes that are listed for sale are available to you via our membership in the Statewide Multiple Listing Service. We simply listen to your needs, wants and your payment requirements, and then match you to all of the homes that are available.

Q. How will I receive my daily home updates?

A. 45,000 Homes For Sale! Our web site searches the Statewide Multiple Listing Service for you on a daily basis. We will automatically update you with daily e. mails of all the new MLS homes listed for sale and the for sale by owner homes that come on the market within your guidelines. Your daily e. mail home listings include listing information, school information, home photos, virtual tours, addresses with map quest directions, daily price reductions, and mortgage calculators!

Q. Can I "drive by" the homes first to see if I want to set up a home showing?

A. Yes, We put you in the driver's seat! We will give you the addresses with map quest and you can do "drive-bys" on all of homes that are available. Or, we can take you on a tour of "the best of the best" within your price range. We make the entire home searching and buying process faster, easier, and more economical for you.

Q. What should a buyer know about attending open houses?

A. Buyer Be-Aware! 99% of the time, when you walk into an open house, you are talking to the seller's agent who listed the house for sale. Their legal responsibility is to separate you from as much money as they possibly can for their seller client. As long as you tell the seller's agent right up front that you have hired your own buyer agent, they will have no problem whatsoever in honoring your legal right to have representation and will answer any and all questions that you may have about the home. The problems arise when you don't tell the seller agent that you have hired an exclusive buyer agent, and they assume that you are their customer.

Q. My agent did a good job the last time I bought, why do I need you now?

A. There are good agents everywhere, but unless the agent declared in writing to you that he/she represents only you, that agent probably was the seller's agent. Our industry has tried for years to represent the seller client while working with the buyer as a customer. Buyers finally discovered that they had no representation, much less "exclusive" representation. Buyers demanded change, because they have long realized that they are the true source of all the funds for the purchase. Unless you specifically contract with an exclusive buyer's agent to represent your best interests, the agent, even if it's your neighbor and best friend, legally must remain loyal to their seller client.

Q. Do you provide home buyer price protection?

A. You will never pay too much for your home when you hire us as your buyer agent! We make your offer to purchase subject to the home appraising for at least the purchase price! If your bank's appraiser appraises the home value lower than purchase price, you can cancel the transaction and receive your full deposit back, or we can renegotiate the price downward. The seller or the seller's agent will never suggest that the home buyers make this a provision of any sale.

Q. Can you help us select our home inspector?

A. Yes! We know who the best inspectors are! You need an inspector that will go through your new home with a fine tooth comb! If your inspector finds any major or minor problems, it is our job to renegotiate with the sellers or the seller's agent to remedy the problems that were found, or reduce the sales price accordingly. This becomes your second round of negotiations! We are exempt from the Home Inspector License Law, which means that we can help you select an excellent, proven home inspector. Under Massachusetts Law, seller agents can't recommend home inspectors.

Q. What other differences can I expect from my exclusive buyer agent?

A. When you hire us, the entire home buying process changes. Unlike the seller's listing agent who is hired to use salesmanship to press the sale of a particular property by selling you on the good points, we help you discover both good and bad features of the homes that fit your needs. We prepare a contract that offers better terms/conditions and targets closing dates that favor the buyer. We look more diligently for a home to suit your needs.

Q. What do the courts say about buyer agency?

A. The 1999 Snyder vs the Oklahoma Realty Commission decision will be just one of many decisions supporting buyer agency. The Court found that "a buyer who relies on the seller's agent or on dual agency does not receive the same degree of legal protection as that afforded by an agent acting solely on behalf of the buyer."

Q. What is the "Home Buyer's Due Diligence Service" that you offer?

A. Before you make an offer on a home, we do a competitive market analysis to determine the value of the home and what price you should offer. We also search public records, prior listings, how long on the market, how much the seller paid for the home, price reductions etc. etc. After you have an accepted offer, and on the day that your home inspection is done, we will go to the Town Hall to check out everything about the home, back to the day that it was built such as taxes, assessments, permits, plot plans, new additions, restrictions, Title 5 septic and anything and everything that could effect the future value of the home. We also check with the local Fire Department for any wood stove permits and buried underground oil tanks. We also advise you on how to check the neighborhood for sex offenders to protect your family. We promise to leave no stone un-turned! We guarantee full disclosure and we will always go to the wall for our buyer client's protection.
